Effective date: September 7, 2026
These Terms and Conditions ("Terms") apply to your use of GroundPreppers.com (the "Website"), which is operated by Ground Preppers ("Ground Preppers," "we," "us," or "our"). By using the Website, you agree to these Terms. If you do not agree, do not use the Website.
Website purpose
The Website provides general information about ground preparation, vegetation processing, soil conditioning, contractor support, and planned products. Website content is informational and may not describe every limitation, site condition, or service requirement.
Estimate requests
Submitting an estimate request does not create a contract, reserve scheduling, guarantee availability, establish a final price, or mean that a property is suitable for our equipment. Any estimate may depend on an onsite assessment and accurate information about location, access, vegetation, soil, slope, drainage, rocks, buried materials, utilities, environmental restrictions, and the intended result.
Unless a written estimate states otherwise, estimates are not offers that can be accepted indefinitely and may be revised when the scope or site conditions differ from the information provided.
Service agreements control
Actual services will be governed by a separate written estimate, work authorization, or service agreement. If these Website Terms conflict with a signed service agreement, the signed service agreement controls for that project.
Website descriptions such as "smooth," "conditioned," "seed-ready," "project-ready," or similar wording describe intended service outcomes, not engineering certifications or guarantees. Ground preparation is not engineered grading, drainage design, excavation, environmental approval, surveying, utility locating, or certified compaction unless expressly included in a signed agreement.
Property and site information
Property owners and authorized contractors are responsible for providing accurate site information and identifying known hazards, boundaries, access restrictions, underground or overhead utilities, private lines, irrigation, septic components, wells, drainage systems, buried debris, regulated areas, and other conditions that may affect the work.
You may request an estimate only for property you own, control, or are authorized to discuss. You may not direct us to enter or perform work on another person's property without permission.
Acceptable use
You agree not to:
- Use the Website unlawfully or to infringe another person's rights
- Submit false, misleading, fraudulent, or unauthorized project information
- Attempt to interfere with Website operation or security
- Introduce malware or use automated systems to scrape, overload, or probe the Website
- Copy or use Website content or branding in a way that suggests affiliation or endorsement
Intellectual property
The Website's branding, logo, original text, graphics, layout, and other content are owned by or licensed to Ground Preppers and are protected by applicable intellectual-property laws. You may view or print reasonable portions for personal evaluation of our services. No other license is granted.
Photographs and submitted materials
You retain ownership of photographs and materials you submit. You grant Ground Preppers permission to review, store, reproduce, and share them with service providers or potential project participants as reasonably necessary to evaluate your request and conduct business. We will not use identifiable customer project photographs for public marketing without permission or another lawful basis.
Third-party services and links
The Website may link to mapping, payment, social media, equipment, supplier, or other third-party services. Ground Preppers does not control and is not responsible for third-party content, availability, security, terms, or privacy practices. A link does not necessarily constitute endorsement.
Planned toolkit products
References to Ground Prep Toolkits or future products do not constitute an offer for sale unless a product is clearly marked as available with current pricing and checkout terms. Product-specific ordering, payment, shipping, return, and warranty terms will be provided before sales begin.
Disclaimer
The Website is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Ground Preppers disclaims implied warranties relating to the Website, including merchantability, fitness for a particular purpose, and noninfringement. We do not warrant that the Website will always be uninterrupted, error-free, secure, or current.
Nothing on the Website is engineering, environmental, agricultural, legal, or other professional advice for a particular property. Consult an appropriately qualified professional or government authority when a project requires specialized review, permits, testing, design, or approval.
Limitation of liability
To the fullest extent permitted by applicable law, Ground Preppers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the Website. Ground Preppers' total liability for a Website-related claim will not exceed the amount, if any, you paid specifically to access the Website. These limitations do not apply where prohibited by law and do not replace the liability terms of a signed service agreement.
Indemnification
To the extent permitted by law, you agree to indemnify and hold Ground Preppers harmless from third-party claims resulting from your unlawful use of the Website, your violation of these Terms, or information or materials you submit without authorization.
Changes and availability
We may change, suspend, or discontinue any Website feature and may update these Terms. Updated Terms become effective when posted with a revised effective date. Continued use after an update constitutes acceptance of the updated Terms.
Governing law and disputes
These Terms are governed by the applicable laws of the jurisdiction in which Ground Preppers is legally organized, without regard to conflict-of-law principles. Any mandatory consumer protections that apply to you remain unaffected. Project-specific dispute terms, if any, will be stated in the applicable service agreement.
Severability and waiver
If any provision is found unenforceable, the remaining provisions remain in effect to the extent permitted by law. Failure to enforce a provision is not a waiver of the right to enforce it later.
